Privacy Notice for Applicants

We are pleased that you are interested in us and have applied, or are applying, for a position at our company. Below, we would like to provide you with information on the processing of your personal data in connection with your application.

Protecting your personal data is important to us. Personal data is information relating to the personal or factual circumstances of an identified or identifiable natural person. This includes, for example, your legal name, address, telephone number and date of birth, as well as any other data that can be linked to an identifiable person.

Our data protection practices comply with statutory provisions, in particular the German Federal Data Protection Act (BDSG) and the EU General Data Protection Regulation (GDPR). The following data protection information serves to fulfil the information obligations arising from the GDPR. These can be found, for example, in Art. 13 and Art. 14 et seq. GDPR.

Who is responsible for data processing?

The controller within the meaning of Art. 4 No. 7 GDPR is the party who, alone or jointly with others, determines the purposes and means of the processing of personal data.

Which of your data do we process, and for what purposes?

We process the data you have sent us in connection with your application in order to assess your suitability for the position (or, if applicable, other open positions within our company) and to carry out the application process. This includes, among other things, applicant master data, CV information, qualifications and references, as well as bank details (for reimbursement of travel expenses) and, if applicable, information on disability/severe disability. The following processes are necessary for this:

  • Importing applications from the functional email inboxes,
  • Processing applications received by post,
  • Creating an overview of the applications received.

No automated profiling is carried out by the controller.

What is the legal basis for this?

The legal basis for processing your personal data in this application process is primarily Section 26(1) BDSG in conjunction with Section 26(8) sentence 2 BDSG in the version applicable from 25 May 2018. Accordingly, the processing of data is permitted if it is necessary in connection with the decision on the establishment of an employment relationship.

If, after completion of the application process, the data is required for the assertion of legal claims, data processing may take place on the basis of the requirements of Art. 6(1)(c) GDPR, for example for the assertion or defence of claims.

Processing applicant data may also require consent pursuant to Art. 6(1)(a) GDPR in conjunction with Section 26(2) BDSG if an applicant is to be included in an applicant pool for possible future cooperation. Consent is voluntary and may be withdrawn at any time with effect for the future. No disadvantages arise from not granting or withdrawing consent.

How long will the data be stored?

Your data is stored and collected both digitally (in our document management system) and in paper form.

In the event of a rejection, data of applicants will be deleted no later than after 6 months.

If you have consented to further storage of your personal data, we will include your data in our applicant pool. There, the data will be deleted after two years.

Your data for the purpose of inclusion in our applicant pool for possible future cooperation will be deleted by us immediately after you withdraw your consent, provided that no statutory retention obligations prevent deletion.

If you are offered a position as part of the application process, the data will be transferred from the applicant data system to our HR data system.

To which recipients will the data be disclosed?

After receipt of your application, your applicant data will be reviewed by the HR department. Application documents within the company are only made accessible to those persons who are directly involved in filling the position. Suitable applications may then be forwarded internally to the managers responsible for the respective open position. In principle, only those persons within the company have access to your data who require it for the proper conduct of our application process. No data is transferred to third parties, in particular not to another country.

Where is the data processed?

The data is processed exclusively on our premises and on the controller’s internal servers.

Your rights as a “data subject”

You have the right to information (Art. 15 GDPR) about the personal data we process about you. In the case of an information request that is not made in writing, we ask for your understanding that we may then request evidence from you proving that you are the person you claim to be.

Furthermore, you have the right to rectification (Art. 16 GDPR) or erasure (Art. 17 GDPR) or restriction (Art. 18 GDPR) of processing, insofar as you are legally entitled to do so.

Furthermore, you have the right to object (Art. 21 GDPR) to processing within the scope of the statutory provisions. The same applies to the right to data portability (Art. 20 GDPR).
